Maricopa County Attorney Rachel Mitchell, who is in charge of reviewing the recommended child abuse charge against Brady Kiser recently shared details about the future course of action in the case with the media. Rachel Mitchell during the press conference took note of the fact that the investigation has been completed by the Chandler Police Department. Rachel Mitchell further shared nuances of the issues that need to be assessed before a fair judgment could be reached in the case. As per US Weekly, Mitchell noted,

“People need to understand that not every tragedy is a crime. My heart goes out to the situation. But there's a difference between civil negligence — where someone can be sued — and criminal negligence. In this case, criminal negligence means that the person fails to perceive a substantial and unjustifiable risk that the result will happen.”

As per 12 News, Mitchell, while addressing the future course of action given the fact that investigations have been completed and recommendations have been issued said,

“It came in this week, officially, and so we're in the process of reviewing it.”

The Chandler Police department has recommended that Brady Kiser be charged with Class 4 Felony of Child Abuse. The Chandler Police department released a statement after the conclusion of its investigation. Addressing the tragic drowning incident that took the 3-year-old Trigg Kiser’s life, the statement released by The Chandler Police Department mentioned its recommendations. According to another report by US Weekly, the statement read:
