The Los Angeles Times reports that one of the reasons Isaiah Lee won't be charged with a felony assault with a deadly weapon is because while he allegedly had a replica gun with a fold-out knife, the weapon was in the bag he was carrying when he allegedly tackled Chapelle on the Hollywood Bowl stage on Tuesday night. The Los Angeles County district attorney’s office has referred Lee's case to the Los Angeles city attorney’s office for misdemeanor filing consideration, according to the The Times, which adds: "After reviewing the evidence, prosecutors determined that while criminal conduct occurred, the evidence as presented did not constitute felony conduct. The D.A.'s office does not prosecute misdemeanor crimes within the city of Los Angeles." ALSO: TMZ obtained audio of Chappelle hours after the attack, saying: "I felt good, how bad does a n***** have to be that Jon Stewart would stomp him!"
